Technical and administrative safeguards for personal information 10. Duty of notification 11. Entrustment of personal information handling 12. Miscellaneous Article 1: Purpose 1. Personal information is collected only after obtaining user consent. These Terms of Use aim to regulate the legal matters between you and the Company, as well as the rights, obligations, responsibilities, and other necessary matters related to the use of the Ignite service (hereinafter "Service") provided by Ignite (hereinafter "Company"). Article 2: Definitions 1. The terms used in these Terms of Use are defined as follows: 1) "Artist (1)" or "User" refers to a customer who applies for membership in accordance with the method designated by the Company after agreeing to these Terms and uses the Service provided by the Company. 2) "Social Login" refers to the function that allows a user intending to use the Service to access and use the Service through their information on a social networking service (SNS) designated by the Company. 3) "Nickname" refers to a combination of letters or numbers chosen by a Member and approved by the Company to distinguish themselves from other Members within the Service. 4) "Paid Service" refers to a service provided by the Company that can be purchased and used for a fee through designated payment methods. 5) "Project" refers to an online bulletin board created by the Company, allowing Members to communicate and collaborate with other Members within the Service. 6) "Artist (2)" refers to a member introduction board created by the Company, allowing Members to share their information publicly and communicate with other Members. 7) "Content" refers to all information provided by a Member within the Service. 8) "Purchaser" refers to a Member who purchases or uses content, whether paid or free, within the Service. 2. Unless otherwise specified in paragraph 1, the definitions of terms used in these Terms of Use shall follow relevant laws, and matters not specified in relevant laws shall follow general commercial practices. Article 3: Effect and Amendment of Terms 1. The Company shall display these Terms of Use on the initial screen of the Service. These Terms take effect upon the user's use of the Service. If a user does not agree to these Terms, they may terminate the Service usage agreement. The Company may amend these Terms within the scope permitted by relevant laws. 2. In case of amendments, the Company shall notify the effective date and reasons for amendment, displaying the revised Terms alongside the current Terms from seven days before the effective date until the day before. For amendments significantly affecting members' rights or obligations, notification shall be made at least 30 days in advance. 3. Users have the right to refuse amended Terms and may discontinue using the Service and withdraw if they do not agree. 4. If a user does not explicitly express refusal to the Company or continues using the Service after the effective date of amended Terms, they are deemed to have agreed to the amended Terms. Article 4: Rules Beyond Terms Matters not specified in these Terms shall be governed by notifications, usage guides, operational policies within the Company or Service, and relevant laws (e.g., Framework Act on Telecommunications, Telecommunications Business Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, and other applicable regulations). Chapter 2: Use of Service Article 5: Membership Eligibility 1. Members of the Service shall use the Service in accordance with these Terms. 2. If individual regulations are established within the Service, members shall use the Service in accordance with these Terms and operational policies. 3. Members may not allow third parties to use, rent, transfer, or sell their membership eligibility. 4. The Company may impose age or usage restrictions on certain services in compliance with the Juvenile Protection Act or other regulations, and lifting such restrictions requires the consent of a legal representative. Article 6: Member Account Information 1. Members are responsible for the account information they provide. 2. If member account information violates these Terms or is deemed inappropriate by the Company, the Company may remove such information without prior notice to the member. Article 7: Member Obligations 1. Members are responsible for managing their ID, password, and SNS IDs/passwords required for social login (collectively, "ID") at their own risk, and the Company bears no responsibility for their management. 2. If a member's ID is used, the Company assumes it is used by the member. 3. If a member becomes aware of theft or unauthorized use of their ID, they must immediately notify the Company. Members shall follow the Company's instructions in such cases. 4. The Company is not liable for damages to members or third parties due to negligence in ID management, errors in use, or third-party use. If unauthorized use of an ID causes damage to the Company, the member shall compensate the Company for such damage. 5. Members shall not infringe on third-party intellectual property rights. Members must not post content protected by copyright law or registered trademarks without prior approval from the rights holder or any other content protected by third-party intellectual property rights. Article 8: Suspension or Termination of Membership 1. The Company may suspend or terminate a member's eligibility without prior notice if the member: 1) Provides false information in reports to the Company. 2) Engages in activities contrary to the purpose of the Service, such as posting obscene content or spam advertisements. 3) Causes unjust harm to other members, as determined by the Company. 4) Violates these Terms or individual regulations. 5) Causes financial or reputational harm to the Company. 6) Cannot be contacted by the Company via email, phone, mail, or other means. 7) Registers using another person's identity. 8) Is under 14 years of age. 9) Provides false information or fails to comply with the Company's requirements. 10) Is deemed inappropriate as a member by the Company. Article 9: Prohibited Actions Members of the Service must not engage in the following actions, and if suspected violations are detected, they must be reported via email or the "Report" function: 1. Actions that violate laws, regulations, or these Terms or are likely to do so. 2. Providing false information that disrupts Service operations. 3. Transferring a Company-provided account to others. 4. Trading business card information or other items with third parties through services not provided by the Company. 5. Actions that may violate public morals. 6. Actions related to or encouraging criminal activities. 7. Using the Service commercially without Company approval. 8. Spreading defamation, false information, or personal information that may benefit or harm specific individuals or groups. 9. Causing significant load on the Service's servers. 10. Reproducing, distributing, or commercially using information obtained through the Service or exploiting known/unknown bugs without Company approval. 11. Using the Service to generate financial benefits for oneself or others. 12. Engaging in criticism, verbal abuse, threats, or actions that defame or disrupt the Company or third parties. 13. Infringing on the intellectual property rights, portrait rights, or other rights of the Company or third parties, or collecting, storing, distributing, or posting other members' personal information. 14. Exchanging or posting obscene or vulgar content, linking to such content, or posting advertisements that may cause discomfort to others. 15. Posting or transmitting content that causes shame, disgust, or fear. 16. Impersonating Company staff, operators, or others, or using another's identity to register information, post content, or send emails. 17. Using the Service for commercial, promotional, political, or illegal election activities without Company consent. 18. Reproducing, modifying, altering, or analyzing the Service or its components. 19. Using information that endangers the safety of oneself or others as member account information. 20. Engaging in or encouraging discrimination, defamation, or violence against the Company or third parties. 21. Infringing on patents, utility models, designs, trademarks, copyrights, portrait rights, or other rights. 22. Including harmful programs such as computer viruses. 23. Aiming to meet strangers for romantic purposes. 24. Listing products without intent to trade. 25. Using stolen accounts or payment methods (e.g., credit cards or phone numbers) to use the Service unfairly. 26. Violating laws or public morals or posing such a risk. 27. Violating these Terms or individual regulations or posing such a risk. 28. Other actions deemed inappropriate by the Company. Article 10: Responsibility and Notification of Service Changes 1. If the Service content changes or terminates due to the launch of new services or other reasons, the Company shall notify members via email to their registered account, notices on the Service's initial screen, announcement boards, or update notifications. Some services may be restricted from the notification date until the termination date. 2. The Company is not liable for damages due to members losing or forgetting registration information (including uninstalling the Service application) and will not take any actions to recover such information. 3. Members are responsible for preparing equipment and communication means necessary to use the Service at their own cost. Article 11: Copyright of Content 1. The copyright of all member content belongs to the member. 2. Infringing on the copyrights or other rights of other users or third parties during Service use is prohibited. Members bear full responsibility for any disputes arising from copyright issues during Service use. 3. Notwithstanding paragraph 1, the Company may use all content posted by members within the Service for related services (e.g., promotion, advertising) domestically and internationally. The Company may plan, modify, or edit such content, and the copyright of secondary content created belongs to the Company. The Company shall comply with copyright laws, and members may take actions such as deletion or making content private through customer service or Service management functions. 4. If the Company intends to use member content in ways beyond those specified in the preceding paragraph, prior consent must be obtained via phone, email, or other messaging methods. Article 12: Provision of Information and Advertisement Placement 1. The Company may place advertisements within the Service to maintain it. 2. Within the scope of relevant laws, the Company may provide members with Service-related information, personalized service information, or other information via email, push notifications, SMS/LMS, phone, or notices on the Company's website or app. Members may opt out of receiving such information or advertisements through the "Settings" screen or email. 3. The Company is not liable for losses or damages arising from members' participation in or transactions with third-party advertisements posted within the Service. Article 13: Content Management 1. If a member's content violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, copyright laws, or other relevant laws, the rights holder may request suspension or deletion of the content per legal procedures, and the Company and member shall take appropriate actions per relevant laws. 2. Even without a rights holder's request, the Company may take temporary measures against content that violates Company policies or relevant laws if there is a recognized reason for rights infringement. Article 14: Ownership of Rights 1. Copyright and other intellectual property rights for the Service and content created by the Company within the Service belong to the Company, except for member content and works provided under partnership agreements. 2. The Company grants members only the right to use accounts (IDs) and content under the conditions set by the Company. Members may not transfer, sell, or use such rights as collateral. Article 15: Use of Paid Services 1. Paid services are operated by the Company or professional partner companies. 2. Partner services are independently owned and operated by the respective companies, under their full responsibility. 3. The Company bears no responsibility for online or offline activities, sales, supply, refunds, after-sales service, or connection issues related to transactions between members and partner companies. 4. Inquiries about partner services can be directed to the customer service of the respective service provider. Article 16: Payment for Paid Services 1. Payments for goods or services purchased within the Service can be made via credit card, bank transfer, mobile phone payment, or other methods. 2. The Company is liable for damages due to payment information leaks, except in cases of user negligence, where the user bears responsibility, and the Company is not liable. Chapter 4: Miscellaneous Article 17: Notification to Members 1. Notifications to members may be made via their designated email, Service notices, alerts, messages, or electronic posts. 2. For notifications to all members, the Company may post on the Company's website or app notice board for at least seven days in lieu of individual notifications. Article 18: Usage Restrictions 1. The Company may establish operational policies beyond these Terms, and if a member violates these Terms or disrupts normal Service operations per the policies, the Company may restrict usage, issue warnings, or terminate the contract. 2. Notwithstanding paragraph 1, the Company may restrict usage for violations of relevant laws, such as identity theft under the Resident Registration Act, payment theft, provision of illegal programs or operational disruptions under the Copyright Act, illegal communications, hacking, distribution of malicious programs, or exceeding access rights under the Act on Promotion of Information and Communications Network Utilization and Information Protection. Restricted members lose all benefits acquired through Service use, and the Company does not provide separate compensation. 3. Usage restrictions or contract terminations under paragraph 1 shall follow the conditions and details in the usage restriction policy, with notifications made as per Article 17. 4. Members may file objections to usage restrictions per the Company's procedures. If the objection is deemed valid, the Company shall immediately restore the member's Service access. Article 19: Damages If a user violates these Terms and causes damage to the Company or third parties, the user shall compensate the Company or third parties and indemnify the Company from such damages. Article 20: Company's Exemption from Liability 1. The Company is not liable for Service disruptions due to user fault. 2. The Company is not liable for the reliability or accuracy of information, materials, or facts posted by users in connection with the Service. 3. The Company is not liable for transactions mediated by the Service between users or between users and third parties or for expected profits from Service use. 4. Except in cases of intentional misconduct by the Company, the Company is exempt from liability for damages due to Service disruptions, changes, or termination. 5. The Company is exempt from liability for members' failure to achieve expected scores or rankings. 6. The Company is exempt from liability for disadvantages or information loss due to members modifying their personal information (including accounts). 7. The Company is not liable for the accuracy or reliability of information, materials, or facts posted by users and does not guarantee data preservation. Members use the Service at their own risk, and all responsibility for damages or disadvantages arising from posted or transmitted materials lies with the member. 8. The Company has no obligation to intervene in disputes between users or between users and third parties mediated by the Service and is not liable for resulting damages. Article 21: Rules Beyond Terms 1. The Company establishes operational policies beyond these Terms, and members must comply with them. 2. Matters not specified in these Terms shall follow the Service's operational policies or individual regulations. In case of conflict between these Terms and other regulations, these Terms take precedence. Article 22: Dispute Resolution 1. These Terms are interpreted and enforced under the laws of the Republic of Korea. Disputes between the Company and users related to Service use shall be subject to the jurisdiction of the court where the Company's registered office is located. Addendum 1. These Terms shall take effect from June 1, 2026.
